Terms & Conditions

1.0    Licence

1.1   The client must ensure that they have a valid signed driving licence providing UK provisional entitlement to learn to drive a category B motor vehicle.

1.2   The client must produce their driving licence before the commencement of their first lesson.

1.3   The client is responsible for any traffic violations whilst they are in charge of the vehicle.

1.4   The client must inform their instructor if they commit any driving offence liable to result in court attendance or endorsements.

1.5   Your instructor is authorised by the Driver and Vehicle Standards Agency(DVSA) to give instruction for reward.

1.6   Your instructor will display the authorising documents issued by the DVSA in the windscreen at all times whilst undertaking instruction for reward.

1.7   Your instructor will make available to anyone with a reasonable need all his/her authorising documents and driving licences.

2.0 Fitness to Drive

2.1   The client must inform their instructor of any disability or injury they may have whether temporary or permanent, which may affect their ability to drive.

2.2   The client must not present for a lesson under the influence of alcohol, illegal drugs or prescribed medication that could impair driving ability. Instructor decision will be final and any lesson fee will be chargeable.

2.3   The client must inform their instructor if they feel unwell in any way before or during a lesson.

2.4   In the interests of safety the client must wear suitable footwear and clothing that does not restrict movement during lessons.

3.0 Behaviour

3.1   Your instructor has the right to terminate the lesson at any stage if they feel that it is inappropriate to continue by reason of the client behaviour, sobriety or state of mind. In these circumstances the lesson fee is chargeable and it is at the instructor’s discretion if he or she provides further transport for the client.

3.2   Your instructor will not tolerate any form of verbal or physical abuse.

3.3   Clients must give a minimum of 48 hours notice of cancellation of a lesson.

3.4   Late cancellations will be charged at the normal lesson rate for the duration of the original booking.  Exceptions will be considered.

3.5   Following a period of illness it is the responsibility of the client to inform their instructor when they are well again. If your instructor does not hear from you then they will assume you are still sick and not attend your next lesson.

3.6   Your instructor  will wait for 15 minutes from the start time of the lesson. Beyond this time the lesson will be deemed to have been cancelled and the fee for the entire period of the booking is chargeable.

3.7   Lessons that start late through the client’s fault, will finish at the time of the original booking and will be charged for at the full rate.  Exceptions may be considered.

3.8   Your instructor will comply with the  Approved Driving Instructor (A.D.I) Code of Practice at all times.

3.9 Your instructor will wear a mask. The client is also required to mask. Your instructor will make available high quality masks.

4.0 Payment

4.1   All lessons must be paid by Bank Transfer, no less than 48 hours in advance of the lesson.

5.0 Medical Fitness to Instruct

5.1   Your instructor will inform you if they feel unwell in any way before or during a lesson. Actions appropriate to the pupil’s ability, confidence and the severity of illness will be taken as appropriate. Where necessary alternative transport for the client will be arranged and the lesson postponed or cancelled. The cost of any test and lesson fees will be refunded to the client or another test and lesson booking will be made for them.

6.0 Cancellation

6.1   In the event of an instructor being unable to provide a lesson it will not be chargeable. Clients should be aware that it may not be possible to notify them of cancellation if a breakdown occurs on the way to the lesson. Your instructor cannot be held responsible for costs arising from short notice cancellations.

6.2   Your instructor will endeavour to arrive on time for your lesson. When delayed for less than 15 minutes this time will be added to the original booking.

6.3   Driving tests take priority over lessons. Therefore, a lesson already booked may have to be cancelled if your instructor receives short notice of a driving test for another pupil.

6.4   The attention of clients is drawn to the period of notice required by the Driver & Vehicle Standards Agency for the cancellation or change of a driving test.

6.5   Where possible pupils will be told in good time of the advisability of cancelling their test. Your instructor cannot be responsible for the loss of the test fee if a client fails to notify the test booking office.

6.6   Your instructor cannot be held responsible for the cancellation of any driving tests by the Driver & Vehicle Standards Agency no matter how short the notice.

6.7   Clients should note that where lessons, tuition, or vehicle hire are cancelled at short notice; because of a cancellation by the pupil or the Driver & Vehicle Standards Agency all fees are chargeable. It may be possible to claim some of the lost fees from the Driver & Vehicle Standards Agency.

6.8   Clients who miss lessons leading up to their driving test are advised to book additional lessons, as necessary, to ensure they are at test standard.

6.9   Weather is often a factor when driving. Your instructor’s decision to cancel or proceed with lessons as a result of weather is final. Lessons cancelled by the instructor due to weather will not be charged. Your instructor will endeavour to give you as much notice as possible.

7.0 Assessment and Monitoring

7.1   Clients may be accompanied on their lesson by a supervising examiner from the Driver & Vehicle Standards Agency, whose job is to ensure that the tuition given meets the required standard. This is a legal requirement and is in the public interest.

7.2   Your instructor reserves the right to withhold the use of the car for a test or a lesson if they believe the client is:

  •  Not licensed to drive.
  •  Under the influence of alcohol or drugs.
  •  Medically unfit (including eyesight).
  •  Not at the driving test standard.
  •  Consistently fails to keep or is late for appointments.
  •  Falls into arrears with payment.
  •  For any other reason your instructor considers the client will be unsafe to be responsible for a motor vehicle.

8.0 Insurance

8.1   The vehicle provided is fully insured for driving tuition and driving tests.

8.2   No liability is accepted by your instructor for loss of or damage to any property belonging to or in the possession of the client.

8.3   The ‘Learner Driver’ or ‘Driving Test Candidate’ will be held responsible for the insurance premium excess amount of £100 towards any repair costs resulting from an accident or damage during a practical driving test. This may be refundable if a third party accepts liability.

9.0 Test Applications

9.1   Your instructor will advise the client of the appropriate time to apply for a driving test. The advice will be based on client progress and the current waiting time for test appointments. It does not imply that the client has reached the necessary standard or that the standard will be reached by the appointed test date.

9.2   Your instructor will advise the client should it become necessary to postpone their driving test. This condition will avoid expense and unnecessary failure and the delay in waiting for additional tests.

10.0 The Driving Test

10.1   Clients must ensure that they have all the required documents with them for the driving test. Failure to comply with this condition will mean the examiner will cancel the test and your instructor fee will be chargeable.

10.2   Clients may be accompanied on test by a supervisory examiner whose job is to ensure that the official standards of testing are observed by examiners. This is a legal requirement and is in the interests of the public.

10.3   Clients may request the examiner to allow your instructor to accompany them on a driving test. This is at the discretion of the examiner. Your instructor will not be able to help you in any way during the test.

10.4   Your instructor cannot be held responsible for any missed test due to unforeseen circumstances such as vehicle break down or accident. Should this occur it is the clients obligation to find an alternative vehicle to take their test in.

11.0 Liability

11.1   The client should be aware that the primary objective of your instructor is to promote road safety. They may have to issue instructions which clients must be prepared to carry out without argument.

11.2   Your instructor will make every effort to train you to the highest standard but can in no way be held liable for any driving errors you commit.

12.0 Refunds

12.1   A refund request can only be made within 60 days of the relevant date.

12.2   If the pupil decides to stop lessons, the pupil may request a refund for any lessons paid for but not taken. Any lessons taken on any such course will be charged at full single lesson price, the remaining hours will be refunded.

12.3   Refunds will only be made to the person or account holder that paid.

12.4   The customer is entitled to a full refund within 14 days for any hours not taken.
